First up Birch and Fern is the name of my family photography website and a trading name for Jess Soper Photography. I run all my accounts and contracts through Jess Soper Photography (basically because I’m only one person and it’s easier that way!) so if you wonder why I’m talking about Jess Soper Photography that’s why!

Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.
Jess Soper Photography (trading as Birch and Fern) may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 24th May, 2018.
What I collect
I may collect the following information:
- ages of children
contact information including email address
demographic information such as postcode, preferences and interests
other information relevant to your photoshoot
What I do with the information I gather
Internal record keeping – to make sure I can contact you/turn up at your shoot/find out what photos you want/ send you a price quote
Occasionally I might use the information provided by clients to work out how to improve my services and market myself better
Security and information storage
I’m very committed to making sure that your information is secure. Your personal details are only ever stored on my third party office management program (I use Studio Ninja for this) they are super secure and meet all the necessary GDPR requirements. The only exception to this will be if you email me details, these will be stored in my Gmail account, again these are on secure servers. Your personal details are not stored on my home computer network or anywhere offline.
At no point will your full names or address be made public, I don’t use people’s surnames when talking about photoshoots involving children, this includes on a blog post or any social media activity. I’m especially careful when children are involved, I do not include details about specific locations regarding your home, or make photos public that would show the whereabouts of your home address, or any other personal details such as the child’s school.

Our website may contain links to other websites of interest. However, once you have used these links to leave our site, you should note that I do not have any control over that other website. Therefore, I cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.
Controlling your personal information
You may choose to restrict the collection or use of your personal information in the following ways:

I do not sell, distribute or lease your personal information to third parties.
You may request details of personal information which I hold about you, just drop me an email or give me a call.
If you believe that any information we are holding on you is incorrect or incomplete, please email me as soon as possible. I will promptly correct it, I don’t want to be calling you the wrong name all day.
If, at any point after your job is complete, you wish me to delete the information I hold about you, you can do this by writing to me or emailing me at soperjess@gmail,com and I will remove your records from my system.
Using your photos for promotional purposes
As I’m sure you’ve noticed, as that’s probably how you found me, I do use photos from family shoots on my website and social media accounts. It’s a bit hard to run a photography business without showing photos of the families you shoot! When you sign your contact, there is a tick box to consent to this. If you’re not happy, don’t tick it. I will always check with you before I post anything. I will always make sure you are comfortable with your photos being used in this way and you can always change your mind at any point and ask me to remove your images. When images are used online there is always the possibility that they can be saved by other people. I do try to protect against this with ‘no save’ options on my blog etc, however like anything online there is no complete guarantee that other people cannot save those images.
Your photos will not be used for any other purposes without your express permission first.
All your images are stored on a password protected gallery on secure servers. I use Smugmug for this. If you do not want your photos stored online please let me know and I will remove them after you have confirmed you have received your USB. However, if they are not stored online I will not be able to replace your images if you lose them. They are also stored on a password encrypted external hard-drive which is kept in a locked location.
